This matter is before the Court on Defendant D.R. Horton, Inc.'s motion to dismiss Plaintiff's complaint for lack of subject matter jurisdiction and failure to state a claim upon which relief can be granted pursuant to Federal Rule of Civil Procedure 12(b)(1) and (6). [ECF No. 4]. The Court grants the motion for the reasons set forth below.
